Terms of Service

These Terms of Service ("Terms") govern your access to and use of GifCard at https://gifcard.shop and related services (the "Service"). By using the Service you agree to these Terms and our Privacy Policy.

If you do not agree, do not use the Service. We may update these Terms; the "Last updated" date will change, and continued use after changes constitutes acceptance where allowed by law.

1. The Service

GifCard lets you create digital greeting cards that may include a personalized message, a GIF (via Giphy or similar), visual styles, and optionally a digital gift card fulfilled through third-party partners (currently Tremendous or successors). You receive a private share link to send to a recipient. Optional accounts let senders track open/claim status.

Features may change. We may add, remove, or limit functionality, catalogs, occasions, or regions at any time.

2. Eligibility

You must be at least 16 years old (or the age of digital consent in your jurisdiction) and able to form a binding contract. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.

3. Accounts

You may use parts of the Service without an account. Sign-in with email and password is required for some features such as the sender dashboard. You are responsible for activity under your account and for keeping your credentials secure. We may suspend accounts that violate these Terms.

4. Cards, content, and acceptable use

You are solely responsible for content you submit (messages, names, images, GIFs you choose).

  • No illegal, harassing, hateful, threatening, or defamatory content.
  • No spam, scams, phishing, malware, or deceptive gift schemes.
  • No infringement of others' IP, privacy, or publicity rights.
  • No attempts to probe, scrape at scale, reverse engineer, or disrupt the Service.
  • No using public card URLs to host content unrelated to personal greetings/gifting.

We may filter, refuse, remove, or disable access to content or cards, and may cooperate with law enforcement when required. Report abuse via in-product controls or support@gifcard.shop.

Share links: cards are reachable by anyone with the link. You must not include secrets (passwords, government IDs, payment details) in card content.

5. Fees and payments

Fees depend on whether you are within the free card allowance, pay-per-card, or an unlimited plan:

  • Free cards: your first 100 successful card sends may have no platform service fee. If you attach a gift on those cards, you still pay the gift face value and applicable payment processing.
  • Later cards: after the free allowance, a platform service fee applies to each card, whether or not a gift is attached, unless you have an active unlimited entitlement. Defaults are A$8.99 (AUD) and US$8.99 (USD / other currencies). The amount shown at checkout is controlling.
  • With a gift: you also pay the gift face value (for the recipient) plus payment processing. Face value is not waived by unlimited plans.
  • Unlimited plans: we may offer time-limited or lifetime unlimited card sending (for example a monthly unlimited plan or a limited founders lifetime plan). Benefits, price, seat caps, and duration are shown at purchase; founders offers may include future card features as described at checkout.
  • Payments are processed by Stripe (or a successor). By paying, you also agree to the payment provider's terms.

Prices may be shown in AUD, USD, or the gift product currency. Taxes may apply based on your location and the nature of the charge. We may change fees and plans; continued use after notice (or the amount at checkout) controls for that purchase.

6. Digital gift cards

  • Gift cards are issued by or through third-party merchants and fulfilment partners (e.g. Tremendous). GifCard is not the bank, issuer, or merchant of record for the underlying store value unless explicitly stated.
  • Availability, denominations, expiration, and redemption rules are set by the issuer / partner and may vary by country. Some catalog items may be fixed-denomination only.
  • After successful payment, the recipient can claim via the card page subject to partner systems. Claim links may be single-use or time-limited as provided by the partner.
  • Refunds: once a gift has been issued or a claim link delivered to a recipient, face value is generally non-refundable. Platform fees are non-refundable except where required by law or where we cancel fulfilment before issuance due to our error. Contact support@gifcard.shop for payment failures or duplicate charges.

7. Third-party services

GIFs, logins, payments, hosting, and gift issuance depend on third parties (Giphy, Google, Meta, Stripe, Tremendous, etc.). Their terms and privacy policies apply to their services. We are not responsible for third-party outages, catalog changes, or redemption failures outside our reasonable control, but we will make reasonable efforts to help resolve fulfilment issues we can influence.

8. Intellectual property

The Service, branding, software, and design are owned by us or our licensors. You receive a limited, non-exclusive, non-transferable license to use the Service as provided. GIFs and merchant marks remain the property of their owners and may require attribution (e.g. Giphy).

You grant us a worldwide, non-exclusive license to host, display, transmit, and create previews (including Open Graph images) of your card content solely to operate the Service.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT CARDS, GIFTS, OR LINKS WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT A RECIPIENT WILL OPEN OR APPRECIATE A CARD.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE PLATFORM SERVICE FEES YOU PAID TO US IN THE THREE MONTHS BEFORE THE CLAIM OR (B) AUD $50.

Nothing in these Terms excludes rights that cannot be excluded under the Australian Consumer Law or other mandatory consumer protections.

11. Indemnity

You will defend and indemnify us against claims arising from your content, your misuse of the Service, or your violation of these Terms or applicable law, except to the extent caused by our wilful misconduct.

12. Suspension and termination

We may suspend or terminate access if you violate these Terms, create risk, or if we discontinue the Service. You may stop using the Service at any time. Provisions that by their nature should survive (including IP, fees owed, disclaimers, liability limits) will survive.

13. Governing law

These Terms are governed by the laws of New South Wales, Australia, without regard to conflict-of-law rules. Courts in New South Wales have exclusive jurisdiction, except where mandatory consumer law gives you the right to bring claims in your local courts.
